Client Service Agreement
By engaging Cleopatra's Yoga and Wellness services I agree to the following:

That I am participating in the Yoga classes or any other exercise programmes offered at Cleopatra’s Yoga and Wellness during which I will receive information and instruction about yoga, physical exercise or health. I recognise that exercise requires physical exertion, which may be strenuous and may cause physical injury, and I am fully aware of the risks and hazards involved.

I understand that it is my responsibility to consult a physician prior to and regarding my participation in the yoga classes, health programs or workshops offered by my instructor or substitute teacher. I represent and warrant that I am physically fit and I have no
medical condition, which would prevent my full participation in these yoga classes, health programmes or workshops. -
If I am pregnant I understand that I participate fully at my own risk and that of my unborn child/children.

In consideration of being permitted to participate in the yoga classes, health programmes or workshops, I agree to assume full responsibility for any risks, injuries or programmes offered by my instructor or substitute teacher.

In further consideration of being permitted to participate in the yoga classes, health programmes or workshops, I knowingly, voluntarily and expressly waive any claim I may have against my instructor or substitute teacher for injury or damages that I may sustain as a result of participating in these programmes.

I understand that from time to time during yoga classes, the instructor may physically adjust students’ form and posture (subject to COVID 19 restrictions). If I do not want such physical adjustments, I will so inform the instructor at each class I attend. I also acknowledge that if I do wish to receive such adjustments, it is my responsibility to inform the instructor when an adjustment has gone as far as I desire at that time.

I hereby take full and sole responsibility from any liability of loss or damage to personal property associated with yoga classes or any other events.

My child (if applicable) has permission to attend yoga classes with Cleopatra’s Yoga and Wellness, trading as Cleopatra’s Yoga and wellness and/or
-
My child/baby and I are participating in classes or services during which she/he will receive information and instruction about yoga and health. I recognise that yoga requires physical exertion, which may be strenuous and may cause physical injury, and I am fully aware of the risks and hazards involved.

I understand that:

It is my responsibility to consult with a physician prior to and regarding my child’s/baby's participation in any physical fitness program, including yoga/baby massage.

I represent and warrant that my child/baby has no medical condition that would prevent her/his participation in physical fitness activities.

If taking part in baby yoga, I confirm that my baby has had the 6-8 week medical check with a health visitor or GP confirming that they have no medical issues and their hips are healthy.

It is my responsibility to detail any injuries, allergies, additional needs and health conditions to Cleopatra in the optional form.
11. When practising at Lillington and Longmoore gardens residents association community at hall at 57 Vauxhall Bridge Road, London SW1V 2LF points above (1-10) hold true. In the event of a fire, you must immediately vacate the premises and move to the Fire Assembly point in the square outside St James- the-Less Church. Cleopatra's Yoga and Wellness guests will not be permitted to re-enter the Community Centre until the premises are declared safe by the emergency services.

12. In consideration of being permitted to participate in the yoga classes, I agree to assume full responsibility for any risks, injuries or damages, known and unknown, which my child/baby or I might incur as a result of participating in the program
In further consideration of being permitted to participate in the yoga/massage classes, I knowingly, voluntarily, and expressly waive any claim I may have against the instructor, the owner, or the leaseholder of the building for injuries or damages that my child may sustain as a result of participating in classes or workshops held by Cleopatras Yoga and Wellness..

In person classes during Coronavirus (COVID-19)

If I attend an in person class whilst Coronavirus restrictions and safety measures are in place, I will:
(A) Take care of myself by following the appropriate government guidance on measures such as hand washing and social distancing.
(B) Follow the protocols and safety measures set out by Cleopatra’s Yoga and Wellness for attending in person classes
(C) Not attend any class I have booked, or the Cleopatra’s Yoga and Wellness physical space, should I be displaying any symptoms or have knowingly been in contact with anyone who is symptomatic.
(D) Inform Cleopatra’s Yoga and wellness should I develop symptoms following attendance at an in person class.

Online & virtual classes
(A) As with our studio or community hall classes, by taking part in any online class, I acknowledge that classes may be physically strenuous, and I voluntarily participate in them with full knowledge that there could be a risk of personal injury.
(B) When practising from home, I accept full responsibility for my home space and the health and safety precautions within this space.
(C) I acknowledge that Cleopatra’s Yoga and wellness accepts no responsibility for any potential injuries as a result of practise outside of the studio space or community hall.
(D) Heather Yoga is not responsible for any injuries I may experience as a result of my use of any material found on the website.
(E) Whilst practising online I am responsible for choosing and taking suitable modifications within my practice and if I choose to divert from the general instructions of the class, then I am doing so at my own discretion.
Yoga In The Park
As with our studio classes and community hall classy, by taking part in any outdoor Cleopatra’s Yoga class, I acknowledge that the practice may be physically strenuous, and I voluntarily participate in them with full knowledge that there could be a risk of personal injury.
When practising outdoors with Cleopatra’s Yoga and Wellness , I will:
(A) take care of myself by following the appropriate government guidance on measures such as hand washing and social distancing
(B) follow the protocols and safety measures set out by the Cleopatra’s Yoga and Wellness team for attending outdoor classes.
(C) not attend any class I have booked, should I be displaying any symptoms or have knowingly been in contact with anyone who is symptomatic.
(D) inform Cleopatra’s Yoga and Wellness should I develop symptoms following attendance at an in person class.
(E) take care of myself when setting up my mat outside, ensuring that I am not practising on uneven ground and that the area which I place my mat down on is clear of any hazards which could cause injury.
(F) I acknowledge that Heather Yoga accepts no responsibility for any potential injuries as a result of practise outside of the public outdoor class.
(G) Whilst practising outdoors I am responsible for choosing and taking suitable modifications within my practice and if I choose to divert from the general instructions of the class, then I am doing so at my own discretion.
I have read the above release and waiver of liability and fully understand its contents. I voluntarily agree to the terms and conditions stated above under my own free will. By booking into any Heather Yoga classes or accessing online material I hereby agree to the terms and conditions above.
Cancellation and Booking Policies

Online payment for classes must be received prior to the scheduled class date to ensure your space.

For classes and workshops, we only accept prior payment online.

Cancellations later than (24 hours for morning classes) prior to class start time for any reason will not be refunded or credited.

If you have a class pass and cancel a class with less than (24) hours notice or fail to turn up you will forfeit one class from your pack. This includes the drop-in class pass.

Classes bought in line with “intro offer" have the same cancellation policy as classes outside of this offer.

Private classes need to be cancelled a minimum of 24 hours in advance.

All payments are non-refundable and non-transferable.

Monthly to month memberships can be cancelled by emailing us on info@cleopatrasyogaandwellness@gmail.com

You must provide one calendar month's notice prior to your next payment date for cancellations of memberships.

Membership fees must be paid in irrespective of whether or not the member has used the facilities.

Memberships are non refundable and non transferable after the initial 14 day cooling off period in line with the Consumer Contract Regulations (2014). You sign up for a minimum period and this will have to be honoured.

Under the Consumer Contract Regulations (2014) you are entitled to cancel an unused membership purchase and contract within 14 days from the date of purchase for which you will receive a full refund. Should you have used your membership within the 14 days cooling off period a partial refund will be provided. Any cancellation requests after this date will not be eligible for a refund.

One off purchases such as the class pass packs are non refundable, non transferable and must be used within the expiry date provided when you make the initial purchase.

Workshops, courses, programmes, events and similar must be cancelled a minimum of 14 days prior to their first start date to receive a full refund, no refunds can be given after.

Class Passes cannot be extended beyond their expiration date. If there is credit remaining on a Class Pass and it expires, the credit will no longer be valid.

Class Changes, Substitutions & Change of Teacher

Classes may be cancelled by the management, a teacher may be substituted or class times may be altered. No refunds will be given under these circumstances as long as Cleopatra’s Yoga and Wellness have offered an extra date for the class and or an opportunity to receive pre recorded content.

If an entire course is cancelled a full refund will be issued.

If the class attendance fails tom reach the minimum required a course may be cancelled up to 12 hours from the start time and a full refund will be issued.

Consumption of food
Assumption of Risk and Waiver of Liability: In consideration of the above, by booking and using Cleopatra's Yoga and Wellness services you assume all risks associated with the preparation of food products supplied under this Agreement, including matters of health and safety associated thereof. You agree to hereby release, waiver, discharge, and covenant not to sue Cleopatra's Yoga and Wellness, their respective Trustees, officers, employees, students and agents from liability from any and all claims including the negligence of Cleopatra's Yoga and Wellness, their respective Trustees, officers, employees and agents, resulting in personal injury, accident, or illness, including death and property loss arising from any and all food products provided under this Agreement.

Our Liability
To the fullest extent permissible by law, we accept no liability to any user for any loss or damage, whether foreseeable or otherwise, in contract, tort (including negligence), for breach of statutory duty, or otherwise, arising out of or in connection with the use of (or inability to use) The Cleopatra’s Yoga and Wellness Website or the use of or reliance upon any Content included on The Cleopatra’s Yoga and Wellness Website.
To the fullest extent permissible by law, we exclude all representations, warranties, and guarantees (whether express or implied) that may apply to The Unwind Yoga Studio Website or any Content included on The Cleopatra’s Yoga and Wellness Website.
If you are a business user, we accept no liability for loss of profits, sales, business or revenue; loss of business opportunity, goodwill or reputation; loss of anticipated savings; business interruption; or for any indirect or consequential loss or damage.
We exercise all reasonable skill and care to ensure that The Cleopatra’s Yoga and Wellness Website is free from viruses and other malware. We accept no liability for any loss or damage resulting from a virus or other malware, a distributed denial of service attack, or other harmful material or event that may adversely affect your hardware, software, data or other material that occurs as a result of your use of The Cleopatra’s Yoga and Wellness website (including the downloading of any Content from it) or any other site referred to on The Cleopatra’s Yoga and Wellness Website.
We neither assume nor accept responsibility or liability arising out of any disruption or non-availability of The Cleopatra’s Yoga and Wellness Website resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, natural events, acts of war, or legal restrictions and censorship.
